Planning Ahead: A Primer on the Intersection of Commercial Leasing Law and the Planning Act

Robert Eisenberg is a property development and commercial leasing lawyer at WeirFoulds LLP who excels at identifying potential landmines and devising clear, creative, and proactive solutions. Robert is building a specialized practice focused on mixed-use developments and is well-versed in the unique challenges inherent in these complex projects. He is valued for his ability to pinpoint and avoid future problems to help ensure that your deal goes smoothly. More generally, Robert acts for both landlords and tenants on negotiating, drafting, reviewing, and revising commercial leasing documents including leases, offers, amendments, assignments, subleases, and consents. He also has experience in large-scale due diligence reviews of properties across Canada.

Julia Sjaarda is a land use planner in WeirFoulds LLP’s Municipal Law Group, working in the municipal, real estate and development area. Julia has worked with both private and public sector clients across Ontario and has been involved in the full spectrum of land use planning, including complex commercial, residential and institutional projects, infill projects, and rural/agricultural planning. Her responsibilities include the coordination and management of various development applications, including official plan amendments, zoning by-law amendments, site plan approvals, consents and minor variances. Julia conducts research, prepares memoranda and provides planning advice as part of the due diligence work conducted by the firm’s lawyers. Julia also assists with Ontario Land Tribunal (formerly the Local Planning Appeal Tribunal and Ontario Municipal Board) hearings, and is a full member of the Ontario Professional Planners Institute (OPPI) and the Canadian Institute of Planners (CIP).

Topic Summary:

In this session, commercial leasing lawyer Robert Eisenberg and planner Julia Sjaarda will explore the impact of the Planning Act, including recent amendments resulting from the passage of Bill 276, on commercial leases in Ontario, and will teach some tricks for mitigating risk and navigate the process of obtaining consents for leasing-related issues.
